FEMA will carry out its Section 106 responsibilities under the National Historic Preservation Act (NHPA) for the reconstruction of the Puerto Rico electrical system by the Puerto Rico Electric Power Authority (PREPA) through development of a Project-Specific Programmatic Agreement (PSPA) as described under Stipulation II.C.6.c of the “Programmatic Agreement among the Federal Emergency Management Agency, the Puerto Rico State Historic Preservation Officer (SHPO), and the Puerto Rico Central Office for Recovery, Reconstruction and Resiliency (COR3),” as amended November 13, 2019.

The need for a PSPA is triggered when a large and complex project, such as the PREPA island-wide electrical system restoration project, presents the expectation of numerous adverse effects on historic properties (archaeological and structures) that cannot be identified and addressed in advance of project implementation.

This PSPA lays out the specific strategy that will guide Section 106 compliance throughout the construction phase of the project.

FEMA is soliciting written comments from those agencies, organizations, and individuals having an interest in the undertaking’s effect on historic properties. Comments received will become part of the FEMA administrative record and will be considered in determining the resolution of adverse effects associated with the undertaking. Written comments are requested on or before the close of the comment period. Comments must reference the PREPA PSPA and should be submitted to fema-ehp-dr4339@fema.dhs.gov .
