FEMA is Seeking Public Comment on a General Applicability Waiver of the Build America, Buy America Act

FEMA is accepting comments from all stakeholders, including state, local, tribal, and territorial governments, nonprofit organizations, private organizations, industry, and individuals regarding the proposed General Applicability Waiver of the Build America, Buy America Act for the State Border Security Reinforcement Fund.

The Federal Emergency Management Agency (FEMA) is proposing a public interest waiver of the requirements of section 70914 of the Build America, Buy America Act (BABA) for the State Border Security Reinforcement Fund.
The State Border Security Reinforcement Fund is a newly established program authorized and appropriated by Congress for the Department of Homeland Security to provide grants to eligible states and units of local government for border security-related expenditures for activities completed, ongoing, or initiated on or after January 20, 2021. In accordance with BABA, FEMA is issuing this notice to propose a general applicability waiver to the Buy America Domestic Content Procurement Preference (commonly referred to as the “Buy America preference”) for federal financial assistance awarded under the State Border Security Reinforcement Fund. This proposed waiver would apply to awards and subawards for eligible infrastructure projects that, as of the date that the program Notice of Funding Opportunity was issued: have already completed planning/design, are under construction, or the construction is already complete.
If approved, this waiver will remain in effect for three (3) years from the date of approval and will apply to FEMA awards made during that period for qualifying infrastructure projects for the duration of the project performance period.
