Dear Mr. Schouten:
This letter is in response to a letter from your office dated April 10, 2012, which transmitted the referenced second appeal on behalf of Des Moines Water Works (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) deobligation of funding for the restoration and stabilization of the river banks near six riverbank filtration wells at the McMullen and Saylorville Water Treatment Plants.
As explained in the enclosed analysis, I have determined that the river banks are not improved and maintained natural features and therefore, are not eligible facilities. Furthermore, no immediate threat to improved property existed as the result of the declared event. Accordingly, I am denying this appeal.
This determination is the final decision on this matter pursuant to 44 CFR §206.206 Appeals. Please inform the Applicant of my decision.
