Dear Mr. McCarton:
This letter is in response to your letter dated May 10, 2007, which transmitted the referenced second appeal on behalf of Ventura County Watershed Protection District (Applicant). The Applicant is appealing the Department of Homeland Securitys Federal Emergency Management Agencys (FEMA) determination that the facility meets the definition of a Flood Control Work (FCW), and that the accumulated debris did not pose an immediate threat to life, public health and safety, or improved property.
As explained in the enclosed analysis, we have determined that the deposited debris did not pose an immediate threat to life, public health and safety, or improved property. Therefore, I am denying the second appeal.
Please inform the Applicant of my decision. My determination constitutes the final decision on this matter as set forth in 44 CFR §206.206.
