Dear Mr. Guthrie:
This is in response to a letter from your office dated June 3, 2021, which transmitted the referenced second appeal on behalf of Fiddler’s Creek Community Development District (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of funding in the amount of $583,789.70 for debris removal.
I have determined that procedurally, Region IV has not finalized its determination regarding the Applicant’s eligibility by first determining which roads, if any, were eligible facilities and whether any work was eligible. In addition, no determination regarding reasonable costs has yet been made. Therefore, this appeal is remanded to the Region IV Public Assistance Branch to address these eligibility issues as well as to determine reasonable costs should the Applicant and facility be found eligible. By copy of this letter, I am requesting the Regional Administrator to take appropriate action.
Please inform the Applicant of my decision. The Applicant’s right to a first appeal is not impacted by this decision. It may re-submit a first appeal pursuant to 44 C.F.R. § 206.206 if it is dissatisfied with the new eligibility determinations regarding this matter.
