Gruber Acting Assistant Secretary, Office of Grants and Training Kip Hawley Assistant Secretary, Transportation Security Administration SUBJECT: Clarifications on Tier I and Tier 2 Eligibility for the FY 2007 Intercity Bus Security Grant Program On January 9, 2007, the Department of Homeland Security (DHS) announced the availability of the FY 2007 Intercity Bus Security Grant Program (IBSGP). Eligible FY 2007 IBSGP applicants will be placed into one of two tiers. Both will be comprised of intercity bus systems that meet the minimum eligibility criteria included within the bullets on p. 5 of the FY 2007 IBSGP Guidance and Application Kit. Tier I will be comprised of the larger intercity bus systems in the country. The purpose of this Information Bulletin is to clarify the eligibility requirements for applying under Tier I or II. Many bus companies are subsidiaries or affiliates, or have other like relationships with other bus companies (for purposes of this grant these companies will be referred to as “affiliated companies”). Bus companies may neither apply for nor receive funding under both Tier I and Tier 2. Eligible Tier 1 companies will be determined based on fleet size. Projects will be selected based on risk informed processes. Consistent with Information Bulletin No. 233, DHS will consider factors such as fleet size, UASI regions served, and type of operation in selecting projects for funding in Tier 1. An affiliated company may elect to compete in Tier 2, even if it is otherwise eligible for Tier 1. However, in such cases, the Tier 1 applicant shall not identify its affiliated company’s statistics in its Tier 1 data submission of fleet size, UASI regions served, or type of operation. Also in these cases the Tier 1 applicant shall not allocate funding awarded to it under Tier 1 to the affiliated company that elected to compete in Tier 2. A Tier 1 applicant that seeks to include affiliated companies in its data submissions for Tier 1 must affirm that it directs security operations for the affiliated company’s fleet of buses. The Tier 1 applicant must obtain a release from the affiliated company affirming: • the affiliated company’s acknowledgement that its being included under a Tier 1 application; • that the affiliated company elects not to apply for funding under Tier 2, and • that the affiliated company agrees to adhere to the Tier 1 applicant’s security program. Copies of the release(s) must be retained by the Tier 1 applicant and provided upon request. However, a summary document identifying all affiliated companies included in the data submitted must be submitted to DHS along with the other data requested in the guidance and Information Bulletin 233. . The date for submitting the information requested via email to askcsid@dhs.gov has been extended to February 9, 2007. Tier 1 eligibility determinations will be made on the basis of the data provided, and DHS will provide a response to applicants in time for them to apply for funding in Tier 2 should they be found ineligible under Tier 1 criteria. Prospective Tier 1 applicants that do not submit their eligibility information to DHS by the February 9, 2007 deadline, will automatically have any applications they submit considered as part of Tier 2. The deadline for submitting proposals for Tier 1 applicants will remain March 6, 2007. Applicants are encouraged to submit scalable projects.
