Procedure Memorandum 57 Expanded Appeals Process Nov 2011

Section 110 of the Flood Disaster Protection Act of 1973 (Public Law 93-234), hereafter referred to as the Act, is intended to ensure an equitable balancing of all interests involved in the setting of new and modified Base (1-percent-annual-chance) Flood Elevation (BFE) determinations. The Act provides for an explicit process of notification and appeals for community officials and for private persons prior to the Federal Emergency Management Agency (FEMA) making the BFE determinations final. “Community” as used in the Act and in this Procedure Memorandum means a community participating in, or in the process of joining, the National Flood Insurance Program (NFIP).
