The proposed flood control project was determined by FEMA to be ineligible as a Minor Flood Control Project, because the project as proposed is not consistent with FEMA's intent to limit eligible structural flood control projects to minor ones.
In addition, the application was submitted after the application deadline of July 1, 2009, in that the project was not fully submitted until February 12, 2013. 
Potential duplication of programs (DOP) in consideration of the U.S. Army Corps of Engineers authority for major flood control projects was also considered in the denial by FEMA Region IV.
