FEMA is accepting comments from all stakeholders, including state, local, tribal, and territorial (SLTT) governments, other recipients/subrecipients, and industry partners regarding the general applicability public interest waiver of the Build America, Buy America Act (BABAA) requirements applicable to FEMA federal financial assistance programs for infrastructure.

FEMA is proposing a general applicability waiver for six months to the Buy America preference requirement in BABAA to provide the agency with sufficient time to maximize the use of American made iron, steel, construction materials, and manufactured products in all federally-funded infrastructure projects. FEMA proposes this transitional waiver to prepare for compliance with the new Made in America standards for iron, steel, construction materials, and manufactured products. This general applicability public interest waiver determination will waive the Buy America preference requirements in the BABAA for a period of six months from approval date in accordance with Office of Management and Budget (OMB) Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure. The six-month general applicability public interest waiver will apply to FEMA Federal Financial Assistance Programs Subject to BABAA Buy America Preference.

FEMA will consider all comments received during the 15-day comment period. Anyone interested in providing comment on the general applicability public interest waiver may submit a comment before June 21, 2022. Be sure to provide your name and contact information along with your comments.

After the 15-day comment period is over, FEMA will submit waiver along with public comments to the OMB for review and approval.
