Consultation on Disaster Declaration Process for Tribes

This page provides information, resources, and status updates about FEMA's tribal consultation on the Tribal Declaration Pilot Guidance, which will describe how FEMA processes and evaluates requests from tribal governments for disaster assistance under the Stafford Act.

Background

On January 29, 2013, President Obama signed the Sandy Recovery Improvement Act.  The Act included a provision to provide federally recognized Indian tribal governments (tribal governments) the option to request a Presidential emergency or major disaster declaration independent of a state.  In order to allow tribes the choice to use the new authority immediately, FEMA is processing tribal declaration requests using current declarations regulations used for state requests.  FEMA seeks to develop a declarations procedures specifically for tribal governments and takes into account the unique circumstances that affect tribal communities. 

Using input from tribal governments in 2013, FEMA developed a first draft of the Tribal Declarations Pilot Guidance in 2014. In 2016, FEMA conducted a third round of consultation with tribal governments through listening sessions throughout the country, on the second draft of the Tribal Declarations Pilot Guidance.

The final guidance, published in January 2017, describes how FEMA processes and evaluates requests for assistance under the Stafford Act from tribal governments. The publication of the final guidance launched the pilot phase of tribal declaration guidance implementation.
