Coronavirus (COVID-19) Pandemic: Public Assistance Programmatic Deadlines (Interim) Version 2

This interim policy supersedes Version 1 of the Coronavirus (COVID-19) Pandemic: Public Assistance Programmatic Deadlines released on June 15, 2022 and is applicable to all COVID-19 declarations. Pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act (Stafford Act), the President issued a nationwide emergency declaration March 13, 2020, and major disaster declarations for the COVID-19 pandemic. This policy applies to the emergency assistance authorized by these declarations.

Public Assistance Simplified Procedures Policy

This policy streamlines application procedure for Small Project funding under the PA program to simplify implementation of the PA program and support rapid recovery for Applicants. The use of simplified procedures, such as submitting self-certified estimates and summary reports, may allow applicants to receive funding early and promotes rapid recovery of the affected community. This policy defines FEMA’s simplified procedures and requirements for Small Projects funded under the PA program.

ARCHIVED: The Coronavirus (COVID-19) Pandemic: Public Assistance Programmatic Deadlines, FEMA Policy # 104-22-0002 establishes PA programmatic deadlines across all COVID-19 emergency and major disaster declarations and describes application of the 100% and 90% federal cost shares. Appendix A includes a table of the programmatic deadlines established in this policy.

The policy establishes requirements for elevating and floodproofing structures funded under the Public Assistance program.

Public Assistance Appeals and Arbitration Policy

The policy mandates that for incidents declared on or after January 1, 2022, applicants and recipients must submit appeals electronically through FEMA’s Grants Portal and clarifies the applicants right to arbitration. The policy clarifies requirements for Public Assistance Appeals and Audits under Stafford Act Section 403 and 44 C.F.R. 206.206.

Coronavirus (COVID-19) Pandemic: Safe Opening and Operation Work Eligible for Public Assistance (Interim), Version 2

This updated interim policy retroactively extends the period of work eligibility to the beginning of the incident period. It also specifies that work conducted from the beginning of the incident period through December 31, 2021 will be reimbursed at a federal cost share of 100 percent. Work conducted after December 31, 2021 will be reimbursed at the federal cost share established at that time.
