Dear Ms. Bink:

This is in response to a letter from your office dated May 27, 2021, which transmitted the referenced second appeal on behalf of Giving Alternative Learners Uplifting Opportunities, Inc. (Applicant).  The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of its Request for Public Assistance (RPA).

The Regional Administrator denied the Applicant’s appeal by letter dated February 1, 2021, and the Applicant submitted its second appeal to you by letter dated April 5, 2021.  The same day, April 5, 2021, FEMA issued FEMA Policy FP-104-21-0003, Coronavirus (COVID-19) Pandemic: Safe Opening and Operation Work Eligible for Public Assistance (Interim).  This policy establishes the parameters for eligible safe opening and operation work in COVID-19 declarations and may impact the Applicant’s RPA.  As such, I am remanding this appeal to FEMA Region II so that the region can review and issue a new first appeal decision that considers the applicability of FEMA Policy FP-104-21-0003.

Please inform the Applicant of my decision.  The Applicant’s right to a second appeal is not impacted by this decision.  It may submit a second appeal pursuant to 44 C.F.R. § 206.206, Appeals if dissatisfied with the Regional Administrator’s new first appeal decision regarding this matter.
