Dear Mr. Ghilarducci:
This is in response to a letter from your office dated January 27, 2021, which transmitted the referenced second appeal on behalf of El Dorado County (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $686,650.41 in costs pertaining to its Net Small Project Overrun (NSPO).
Under Title 44 of the Code of Federal Regulations § 206.204(e)(2), when an applicant discovers a significant overrun related to the total final cost for all small projects, it may submit an appeal for additional funding, in accordance with § 206.206, within 60 days following the completion of all its small projects. The Applicant completed work on its last small project on May 23, 2018, but the Applicant did not submit its first appeal for a net small project cost overrun until October 18, 2019. This was after the 60-day timeframe required by FEMA’s regulations, making the Applicant’s first appeal untimely. Therefore, this appeal is denied.
