Dear Mr. Moskowitz:
This is in response to a letter from your office dated November 19, 2018, which transmitted the referenced second appeal on behalf of Escambia Community Holdings, Inc. (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of its first appeal and requests that in order to participate in the PAAP Pilot Program, a fixed-cost agreement for Project Worksheet (PW) 888 be based on an estimate it supplied or that an extension be granted for more time for the parties to reach an agreement be granted. The Applicant also challenges reductions based on insurance proceeds and seeks costs for an insurance adjuster’s estimate.
As explained in the enclosed analysis, the deadline to agree on the scope of work (SOW) and a fixed-cost estimate under the PAAP Pilot has long passed. Therefore, the Applicant’s request for a time extension is not warranted, but the project can proceed under standard procedures. Additionally, the Applicant has not supported a change in the project’s SOW or additional estimated costs. I also find that FEMA properly applied reductions for building damage insurance proceeds and that the applicant’s costs for obtaining its own insurance estimate are not eligible.
Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 C.F.R. § 206.206, Appeals.
