Dear Col. Squires:
This is in response to a letter from your office dated October 17, 2012, which transmitted the referenced second appeal on behalf of the City of Taylorsville (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $650,000 for the repair of Canal Street including slope stabilization measures.
As explained in the enclosed analysis, I have determined that the instability of the slope supporting Canal Street was not caused by the declared event, and slope stabilization measures are not eligible for funding. Therefore, I am denying the appeal. The Applicant may submit a request for funding of the road repair through your office; however, the Acting Regional Administrator can only consider funding the repair of the road surface if the Applicant is able to sufficiently document that the site has been rendered stable through its own means.
Please inform the Applicant of my decision. This determination constitutes the final decision on this matter pursuant to 44 CFR §206.206, Appeals.
