Dear Mr. Ghilarducci:
This letter is in response to a letter from your office dated October 9, 2012, which transmitted the referenced second appeal on behalf of the City of Laguna Beach (Applicant). The Applicant requests that the Department of Homeland Security’s Federal Emergency Management Agency (FEMA) fund a slope stabilization project following the December 2010 winter storms in the amount of $481,510.
As explained in the enclosed analysis, the damaged site was not eligible for permanent repair because the estimated cost of repairing the documented damage was less than the regulatory threshold. Furthermore, the proposed slope stabilization is not eligible as emergency work because the Applicant has not sufficiently demonstrated that the post-disaster condition of the slope poses an immediate threat of additional damage to the Pacific Vista, the road located up-slope of the eroded area. I have determined that the Regional Administrator’s decision in the first appeal is consistent with Public Assistance Program regulations and policy. Accordingly, I am denying the second appeal.
This determination is the final decision on this matter pursuant to 44 CFR §206.206, Appeals. Please inform the Applicant of my decision.
