Dear Mr. Ghilarducci:
This letter is in response to a letter from your office dated May 3, 2012, which transmitted the referenced second appeal on behalf of the City of San Buenaventura (Applicant). The Applicant appealed the Department of Homeland Security's Federal Emergency Management Agency's (FEMA) decision to deny a time extension and additional funding for two hazard mitigation proposals.
As explained in the enclosed analysis, I have determined that Response and Recovery Policy 9526.1 Hazard Mitigation Funding under Section 406 (Stafford Act) dated August 13, 1998, in effect at the time of the disaster, was applied correctly and the hazard mitigation proposals are not cost effective. Because there is no eligible work, a time extension is not required. Accordingly, I am denying this appeal.
Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 CFR §206.206, Appeals.
