Dear Mr. Jacks:
This is in response to your letter dated January 19, 2007, transmitting the second appeal from Los Angeles County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA’s) denial to increase funding for the repair of damages to a section of Las Flores Canyon Road.
For reasons explained in the enclosed analysis, I have determined that the claim of $612,948, $428,970, over the obligated Project Worksheet (PW), for costs associated with a scope of work reflecting a soldier pile wall length of 83 feet is not eligible for FEMA assistance. I also have determined that a scope of work for a 78-foot long soldier pile wall, with piles spaced 6-feet on-centers, and a cast-in-place reinforced concrete wall are eligible. Further, the costs to be used for the 78-foot wall will be on the basis of the original data provided by the Applicant Therefore, the second appeal is partially approved. The Regional Administrator will prepare a PW to reflect the 78-foot wall described in the analysis.
Please inform the Applicant of my decision. My determination constitutes the final decision on this matter as set forth in 44 CFR §206.206.
