As a result of the May 2004 flooding (FEMA-1515-DR-ND), Ramsey County (Applicant) submitted a request for funding to repair 54 damaged road sites in Minnewauken Township. FEMA approved Project Worksheet (PW) 248 on July 20, 2004, for $41,625 to fund the repair of gravel roads at 37 sites. If emergency vehicles would have to detour more than eight miles at an inundated site, FEMA approved grade raises in conjunction with the road repairs to provide access for emergency vehicles. At Site 15, the eligible scope of work did not include a grade raise, because this criterion was not met. On September 26, 2004, the Applicant submitted a first appeal requesting additional funding for several sites addressed in PW 248, including $13,029 for an emergency grade raise at Site 15. The Applicant asserted that the grade was raised to accommodate emergency vehicles because the site detours were too soft for them to use. On November 30, 2005, FEMA denied the Applicant’s first appeal stating that the approved scope of work was in accordance with disaster specific guidance for emergency grade raises.
The Applicant filed a second appeal with FEMA on May 1, 2006, five months after the first appeal was denied. The appeal reiterates that neither the five-mile nor eight-mile detour could support heavy emergency vehicle traffic.
