Dear Mr. Najera:
This letter is in response to the second appeal of damage survey reports (DSRs) 49949 and 69160, in which the City of Agoura Hills requested disaster assistance funds for stabilization of a failed hillside adjacent to Calle Montecillo Road. Your letter dated December 13, 1996, forwarded the second appeal to the Associate Director.
Based on review of all the documentation submitted, I have determined that eligible funding is limited to repair of the roadway section and design costs expended prior to notification of deobligation of DSR 49949. Permanent stabilization is not eligible for funding. The basis for this determination is explained in the enclosed appeal analysis. I have asked the Regional Director to prepare a DSR to reflect this determination.
In the event that the applicant does not agree with this determination, a third appeal may be submitted to the Director pursuant to 44 CFR 206.206(e).
