PURPOSE: Respond to third appeal submitted by the City of Santa Monica for restoration of the Engineering and Design Services.
DISCUSSION: Seismic activity associated with FEMA-1008-DR-CA resulted in minor architectural damages to the Montana Library and Clover Park Administrative Building in the City of Santa Monica. FEMA prepared DSR 76720 for $2,613 and DSR 22960 for $4,506 to cover repairs of these facilities. The scopes of work for these DSRs consists of patching and painting walls, repair of a bookcase and door, replacement of lighting fixtures, and inspection services. The subgrantee and OES did not concur with FEMA's determination that the scopes of work did not require engineering and design services. FEMA denied the subgrantee's first and second appeals because the subgrantee did not establish that the repairs were complex enough to require engineering and design services. In their third appeal, the subgrantee states that costs for engineering and design services were incurred under a contract for disaster repairs at 34 separate locations. However, the subgrantee has not submitted information to establish that engineering and design services are attributable to the repair of the disaster-related damage. As such, engineering and design services are not eligible. In addition, the subgrantee is requesting additional funding for a cost overrun related to inspection services. However, the subgrantee may submit an appeal for additional funding of cost overruns if there is an aggregate cost overrun of all of its small projects. Therefore, this appeal should be denied.
RECOMMENDED ACTION: Sign the letter denying the appeal.
