The applicant must provide documentation to support the appeal. Supporting documentation should explain why the applicant believes the original determination is wrong and the dollar amount in dispute. The recipient (e.g., State, Tribe, or Territory) (see Note 2) will then prepare a written recommendation. The recipient has full discretion to support or oppose all or part of the applicant’s position in the appeal. Per 44 C.F.R. § 206.206, first level appeals are evaluated and decided by the FEMA Regional Administrator responsible for the State, Tribal Nation, or Territory where the disaster occurred. The FEMA Regional Office has 90 days to render a first appeal decision or request more information from the applicant. Once a decision on the appeal is made, FEMA will notify the recipient and applicant. Upon receipt of a denial or partial denial from the Regional Administrator, the applicant has the option to file a second level appeal, though certain applicants may opt to pursue arbitration in lieu of a second level appeal.\n\nSecond Level Appeal\nThe applicant may file a second level appeal of the Regional Administrator’s first appeal decision. The applicant may provide new documentation with the second appeal if necessary. The second appeal should explain why the applicant believes the original determination is wrong and the dollar amount in dispute. The recipient will then prepare a written recommendation. As with the first level appeal, the recipient has full discretion to support or oppose all or part of the applicant’s position. FEMA has 90 days from receipt of the second level appeal to render a decision or request more information from the applicant. Second level appeals are the Agency's final determination, as outlined in regulation (44 C.F.R. § 206.206). All second level appeal determinations are posted on the FEMA website (www.fema.gov), so applicants can review previous decisions FEMA has made on similar issues.\n\nAppeal Submission Deadlines\nFor disasters declared after January 1, 2022, an applicant must electronically submit its appeal to the recipient within 60 days from the date FEMA electronically transmits the eligibility determination or first appeal decision. The recipient has 120 days from the determination or first appeal decision transmission date to submit the applicant’s appeal through Grants Portal/Grants Manager to FEMA.\n\nFor disasters declared prior to January 1, 2022, an applicant must submit its appeal to the recipient within 60 days of receiving notice of FEMA’s eligibility determination or first appeal decision.
