A facility operated by the Waterworks District No. Four of Ward Four of Calcasieu Parish (Applicant) was without power for approximately five days following Hurricane Rita. Subsequently, the Applicant purchased a 500-kilowatt generator to power the facility and maintain water service in the event of extended power outage. The Applicant purchased the generator after primary power to the facility was restored. FEMA decided not to fund PW 4147 because the costs associated with the generator are ineligible. The generator was not used as a result of the disaster. In its first appeal, the Applicant claimed that FEMA assured it that the cost to purchase a generator was reimbursable. The Regional Administrator denied the appeal stating that the cost is not eligible because it was not incurred in performing eligible work. In its second appeal, the Applicant claims that a FEMA Federal Coordinating Officer informed the Applicant that FEMA would reimburse the entire cost to purchase emergency equipment provided it was purchased within 30 days following the event. The appeal contained insufficient documentation to substantiate the claim.
Was the generator used to eliminate an immediate threat to public health and safety or improved property?
No. The generator was not used at any time as a direct result of the disaster.
