Manning Deputy Administrator National Preparedness and Protection SUBJECT: Clarifications to Fiscal Year 2010 Program Guidance and Application Kits Homeland Security Grant Program (HSGP) Management and Administration (M&A) Limits: M&A will be implemented exactly as it was in FY 2009 except that grantees may retain and use up to 5% Homeland Security Grant Program (HSGP) funds towards M&A costs and sub grantees may retain and use a similar amount of their sub award for M&A purposes. Any M&A funds retained are to be used solely for purposes associated with the HSGP award. No M&A funds may be used to support the FY 2010 OPSG Program. Law Enforcement Terrorism Prevention Activities (LETPA): Consistent with the 9/11 Act, grantees are required to ensure that at least 25% of appropriated SHSP and 25% of appropriated UASI program funds are dedicated towards LETPA. Final allocated amounts are less than appropriated amounts due to FEMA management and administration costs and carve-outs for Operation Stone Garden, Tribal HSGP, and UASI Non-Profit Security Grant Program. Consequently, the actual amount required for LETPA is actually slightly more than 25% of the grantee’s allocation. This is consistent with the FY 2009 requirements and was previously discussed in IB 326 and IB 297. Port Security Grant Program (PSGP) .. The Anchorage Port Area was missing from the allocation table in the FY 2010 PSGP Guidance and Application Kit but is correctly listed in IB 338 as a Group II Port Area and is subject to the guidance requirements of the Fiduciary Agent process. .. The Texas City port within the Houston-Galveston Port Area was missing from the allocation table in the FY 2010 PSGP Guidance and Application Kit but is correctly listed in IB 338 as part of the Group I Houston-Galveston Port Area, and is subject to the guidance requirements of the Fiduciary Agent process. .. The Group III Port Area for Texas listed in the FY 2010 PSGP Guidance and IB 338 is modified as follows: Brownsville Port Lavaca-Point Comfort Victoria .. Perth Amboy was listed as a Group III Port Area in the FY 2010 PSGP Guidance and Application Kit and IB 338, but is actually within the Group 1 New York/New Jersey Port Area and is subject to the guidance requirements of the Fiduciary Agent process. The attached FY 2010 PSGP Target Allocations table replaces previous versions provided in both the FY 2010 PSGP Guidance and Application Kit and IB 338.
