Manning Deputy Administrator National Prepardness Federal Emergency Management Agency SUBJECT: Port Security Grant Program (PSGP) Fiduciary Agent (FA) Match Exemption Clarifications for the FY 2007 Supplemental through the FY 2009 Grant Awards. The purpose of this communication is to clarify the match exemptions for grantees serving as Fiduciary Agents (FAs) for the FY 2007 Supplemental, FY 2008 and the FY 2009 Port Security Grant Program (PSGP). The following exemptions apply to the FY 2007 Supplemental PSGP through the FY 2009 PSGP: Regarding Management and Administration (M&A) limits, a maximum of 3% of the total award amount may be retained by the Fiduciary Agent, and any funds retained are to be used solely for management and administrative purposes associated with the PSGP award. To clarify, there is no cost-share associated with this 3% for Fiduciary Agents. There is also no matching requirement for costs associated with the development of Port-Wide Risk Management/Mitigation and Business Continuity/Resumption of Trade Plan for Group 1 and Group 2 port areas under the FY 2007 PSGP Supplemental through the FY 2009 PSGP. Such costs are limited to 20% of the award amount for these port areas. Follow-on projects in support of the plans will be required to comply with the matching requirements. After the plan is completed, Fiduciary Agents are subject to a 25% match of the total award amount (with the exception of M&A). This includes any PSGP funds used for www.fema.gov updates and/or modifications to the Port-Wide Risk Management/Mitigation and Business Continuity/Resumption of Trade Plan.
