Federal employees with same-sex spouses are now provided the same Family and Medical Leave Act entitlements as those with opposite-sex spouses.
The effective date of this directive is June 26. Normally an employee may not retroactively invoke entitlement to FMLA leave. However, if an employee took otherwise qualifying leave for a same-sex spouse between June 26 and Oct. 21, then the employee may re-designate such time off as FMLA leave. Any re-designation of such leave needs to be made by the end of the second pay period following Oct. 28.
