Summary: The City of Blair, Nebraska (Applicant) was impacted by severe winter storms and snowstorms from December 22, 2009 to January 8, 2010. A major disaster was declared for Nebraska on February 25, 2010. FEMA prepared Project Worksheets (PWs) 466 and 469 to document the Applicant’s cost for snow removal and road repair. FEMA determined the PWs to be ineligible due to the Applicant not meeting the record or near record criteria pursuant to
44 CFR §206.227 and Disaster Assistance Policy DAP 9523.1 Snow Assistance and Severe Winter Storm. In its first appeal the Applicant states that Washington County, in which the City of Blair is located, should have been declared a snow removal county due to a two-day record snowfall. The Applicant was informed at the time of project formulation that it was not eligible for reimbursement of snow removal costs, however, FEMA agreed to conduct a technical analysis of the claimed damages and snowfall records. Based on the analysis, the documentation provided by the Applicant, and the fact that Washington County was not a designated snow removal county, the Regional Administrator denied the appeal.
In its second appeal, the Applicant reiterated its claim that Washington County should be declared in the Category B – Snow Removal Assistance designated counties. The Applicant did not provide any new documentation to support its claim.
Issues: Is the Applicant eligible for reimbursement of snow removal costs?
Findings: No. Washington County was not a designated snow removal county (Category B – Snow Removal) for FEMA-1878-DR-NE.
