Summary:In the aftermath of Hurricane Katrina, FEMA extended the Request for Public Assistance (RPA) deadline to March 1, 2006.Desire Community Housing Corporation (DCHC) submitted an RPA on February 23, 2007, approximately one year after the March 1, 2006, regulatory deadline.In its first appeal submitted June 15, 2007, DHDC stated that it did not have access to the internet or television and was not aware of Public Assistance funding until January 19, 2007.The Acting Regional Administrator determined that DCHC was not an eligible Private Non-Profit, DCHC did not complete the Small Business Administration application in accordance with 44 CFR § 206.226 (c)(2), and that there were no extenuating circumstances beyond the DCHC’s control that prevented it from applying for FEMA assistance and denied the appeal on July 10, 2009.The State asserted that it did not communicate properly with potential applicants and FEMA should accept the late RPA because the DCHC is eligible for assistance and has received funding in the past.The DCHC filed a second appeal on September 23, 2009. DCHC did not submit adequate information to support its request.
On February 4, 2010, the Public Assistance Division Director met with DCHC in Washington D.C.DCHC and the State reiterated its original claim stated in the first appeal.
