FEMA-1603-DR-LA, University of New Orleans-Summary:
The University of New Orleans is appealing the denial of PW 13242 for $199,435 for the costs of transporting and sheltering student-athletes at other university facilities, hotels and apartments. FEMA deemed the PW ineligible because housing student-athletes at a location where they could practice athletics was not considered an emergency protective measure to eliminate an immediate threat to health and safety. The Applicant submitted its first appeal asserting that the PW was written for the cost associated with transferring student athletes to other institutions in order to continue the athletic programs because the sports facilities were in disrepair. In a letter dated July 31, 2007, the Regional Administrator denied the appeal on the basis that student-athletes were relocated to other institutions with their respective teams in order to continue the Universitys athletic program, which is not an essential function of the Universitys curriculum. In its second appeal, the Applicant argues that FEMA mistakenly based its determination on the evaluation of the temporary relocation of the Universitys sports facility rather than on the transportation and interim sheltering costs for its student-athletes. The Applicant also states that FEMA officials committed to reimbursing these costs, which is consistent with FEMAs sheltering guidance. Issues:
