Dear Mr. Ghilarducci:
This is in response to a letter from your office dated July 20, 2012, which transmitted the referenced second appeal on behalf of San Diego County (Applicant). The Applicant is appealing the Department of Homeland Security's Federal Emergency Management Agency's (FEMA) decision to deny its request for additional funding for the repair of five sites along Wynola Road and requests that FEMA approve $535,042 for the proposed scope of work.
As explained in the enclosed analysis, I have determined that the only eligible line items omitted from the original scope of work are the Water Pollution Control Plan and temporary erosion control measures during construction at Sites 1 through 4. The proposed work for Site 5 does not meet the criteria for permanent work or emergency protective measures and is not eligible. Accordingly, I am partially approving this appeal for an additional $8,930 in eligible costs. By copy of this letter, I am requesting the Regional Administrator to take appropriate action to implement this determination.
Please inform the Applicant of my decision. This determination is the final decision on this matter pursuant to 44 CFR §206.206, Appeals.
