Dear Mr. Wilz:
This letter is in response to your letter dated October 12, 2010, which transmitted the referenced second appeal from Ransom County (Applicant). The Applicant is appealing the U.S. Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) denial of $24,953 in funding for repair of a gravel road and replacement of a culvert in Springer Township.
As explained in the enclosed analysis, the observations made by the Preliminary Damage Assessment team do not constitute final eligibility determinations for specific projects. Furthermore, the documentation submitted with the appeal does not substantiate the Applicant’s claim that the declared disaster damaged the culvert. I have reviewed the information submitted with the appeal and have determined that the Regional Administrator’s decision in the first appeal is consistent with Public Assistance regulations and policy. Accordingly, I am denying this appeal.
Please inform the Applicant of my decision. This determination constitutes the final decision on this matter pursuant to 44 CFR §206.206, Appeals.
