Dear Mr. McCarton:
This is in response to your letter dated November 30, 2006, which transmitted the referenced second appeal for Los Angeles County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) decision regarding funding for repairs to a retaining wall and roadway shoulder damaged in the declared event.
As explained in the enclosed analysis, the Applicant provided information that supports the request to allow for cast-in-place reinforced concrete panels in lieu of timber lagging for public safety reasons in light of the persistent wildfire threat that exists in this locale. However, the Applicant failed to provide documentation in support of the requested increase in project funding. Therefore, I am granting the request for a change in the scope of work. The approved change in scope of work will possibly increase the cost of the project. We will reconcile costs for the approved scope of work during closeout. By copy of this letter, I request that the Regional Administrator take appropriate action to implement this decision.
Please inform the Applicant of my decision. This determination constitutes the final decision on this matter as set forth in 44 CFR §206.206, Appeals.
