Dear Mr. McCarton:
This is in response to the letter dated December 14, 2006, from your office which transmitted the referenced second appeal for Los Angeles County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) decision regarding funding for construction of a retaining wall for site restoration and road repairs as a result of a slope failure.
As explained in the enclosed analysis, the Applicant provided information that supports the requested changes, such as a reduction in the spacing between soldier piles. Therefore, I am granting the request for a change in the scope of work. The approved change in scope of work will increase the cost of the project. FEMA will reconcile costs for the approved scope of work at project closeout. By copy of this letter, I request that the Regional Administrator take appropriate action to implement this decision.
Please inform the Applicant of my decision. My determination constitutes the final decision on this matter as set forth in 44 CFR §206.206, Appeals.
