Dear Mr. Long:
This is in response to your letter dated July 7, 2008, which transmitted the referenced second appeal on behalf of the City of Gulf Shores (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) decision to deny an additional $4,515,148 for replacing sand that Hurricane Katrina eroded from its public beaches.
As explained in the enclosed analysis, I have determined that the Applicant is eligible to receive an additional $3,926,864 for replacing sand that Hurricane Katrina eroded from its beaches. Accordingly, I partially approve the appeal. By copy of this letter, I request that the Regional Administrator take appropriate action to implement this determination.
Please inform the Applicant of my determination. My determination constitutes the final decision on this matter as set forth in 44 CFR §206.206, Appeals.
