This is in response to your letter dated October 14, 2005, transmitting the second appeal of the North Carolina Department of Parks and Recreation (Applicant) dated October 13, 2005, of the Office of Inspector General Audit Report # DA-33-04. It should be noted that the appeal was first addressed by FEMA Region IV as a first appeal of the audit. You requested that the Regional Director transmit it as a second appeal to my office. We apologize for the delay in responding.
The appeal disputes the basis on which the Department of Homeland Security’s Federal Emergency Management Agency (FEMA) deobligated funding for debris removal and the restoration of the Kerr Lake shoreline and boat ramps. As explained in the enclosed appeal analysis, I have determined that the Applicant is eligible for an additional $960,000 for debris removal and $972,173 for repair to the Lake Kerr shoreline. Therefore, I am partially approving the appeal.
Please inform the applicant of my decision. This determination constitutes the final decision on this matter pursuant to 44 CFR § 206.206.
