Dear Mr. Jacks:
This is in response to your letter dated February 9, 2007, which transmitted the referenced second appeal on behalf of Los Angeles County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA) decision not to revise the scope of work and increase funding for the repairs to a section of Newell Road.
As explained in the enclosed analysis, we have determined that the Applicant’s proposed scope of work is not necessary and reasonable to repair the damage caused by the declared incident. The Applicant may undertake such a project. However, Federal funding will be limited to the Federal share of the approved estimate of eligible costs. Therefore, I am denying the Applicant’s second appeal.
Please inform the Applicant of my decision. My determination constitutes the final decision on this matter as set forth in 44 CFR §206.206.
