Dear Mr. Jacks:
This is in response to your letter dated December 27, 2006, which transmitted the referenced second appeal on behalf of Los Angeles County (Applicant). The Applicant is appealing the Department of Homeland Security’s Federal Emergency Management Agency’s (FEMA’s) denial of a request for increased funding for the repair of damages to a section of Marquette Drive.
As explained in the enclosed analysis, the information submitted by the Applicant with the appeals, as well as information in the PW file, does not justify an increase in the length of retaining wall. Therefore, I am denying the Applicant’s request for the additional length of wall, but I am granting the inclusion of a cast-in-place concrete wall as a fire protection measure, along with additional anchored tiebacks. By copy of this letter, I am requesting that the Regional Administrator take appropriate action to implement this determination.
Please inform the Applicant of my decision. My determination constitutes the final decision on this matter as set forth in 44 CFR §206.206.
