Summary: Following Hurricane Georges, the Las Carolinas Bridge in the Municipality of Caguas (Municipality) was damaged. FEMA approved two PWs for the bridge repair and associated A&E costs totaling $71,448. At this time, the Municipality also received a $500,000 grant for a new bridge from the Rural Economic Community Development Agency (RECD). Due to an overrun in construction cost, the Municipality requested to use the FEMA funds to augment the RECD grant. The Region II Disaster Recovery Manager denied the first appeal because Section 312 of the Stafford Act states that FEMA cannot provide funds when the applicant obtains funds from another source.
In the second appeal, the Municipality reiterated its claim that FEMA funds should be used to address the cost overrun in construction costs. The Municipality suggested FEMA pay for several items that were already in the RECD-funded project.
Issues: Should FEMA supplement funds for a project financed by another Federal Agency?
Findings: No, when another Federal agency is authorized to provide disaster-related assistance, FEMA cannot provide funding for that project. The Stafford Act also prohibits duplication of assistance.
