Dear Mr. Christian:
This letter is in response to the referenced third appeal, transmitted by your October 9, 1998, letter. The referenced Damage Survey Reports were prepared for vegetation and sediment removal, and bench restoration on the Pajaro River channel.
As discussed in the enclosed analysis, I have found that the subject 7.5-mile stretch of the Pajaro River channel is an engineered channel such that debris and sediment removal activities to restore the channel and its banks to pre-disaster condition are eligible as Category D. However, removal of vegetation, debris and sediments which were present prior to the disaster are not eligible for assistance. By copy of this letter, I am requesting the Regional Director to prepare a Category D DSR to fund the eligible scope of work described in the analysis.
The subgrantee's appeal is partially granted. Please inform the subgrantee of my determination, which constitutes the final level of appeal in accordance with 44 CFR 206.206(e).
