Dear Mr. Christian:

This is in response to your October 27, 1998 letter supporting the Ventura River County Water District's (VRCWD's) request for a reconsideration of Damage Survey Report (DSR) 26266 (FEMA-1044-DR-CA). Effective May 8, 1998, disaster regulations allow for two appeal levels, one to the Regional Director and one to Federal Emergency Management Agency (FEMA) headquarters. After careful review of all information submitted, I denied VRCWD's second appeal on July 20, 1998.

DSR 26266 was originally obligated for $11,700 to fund repair and replacement of the water main damaged due to a hillside slope failure following heavy rains in Ventura County in January 1995. In response to the second appeal, the approved DSR amount was increased to $49,795. This amount reflects the cost of repairing and replacing the existing line, as the cost of a mitigation effort exceeded the eligible cost to benefit ratio. Due to the unfavorable cost to benefit ratio, I decided in the second appeal that the full cost of relocating the water main could not be reimbursed.

Each second appeal proceeds through a comprehensive process and receives full internal scrutiny. This process provides the applicant with an expedited final decision by the agency. Upon review of my second appeal determination and the information included with the request for reconsideration, I have concluded that all relevant facts were considered in the evaluation of the second appeal. Therefore, there is no compelling reason to reconsider my second appeal decision and reevaluate the merits of the case.

Accordingly, your request is denied. The work is eligible for only $49,795 in federal assistance.
