Any owner of property within a community where a proposed Base Flood Elevation (BFE) determination has been made may file a written "appeal" with their local floodplain administrator within the mandated 90-day appeal period if they believe the proposed determination is in error. An objection to information other than a BFE, such as floodplain boundaries or street names, is considered a "protest" and is submitted during that same 90-day timeframe.
Submitting an appeal requires data proving that the proposed BFEs are scientifically or technically incorrect. Depending upon the type of information being challenged, protests may require similar documentation. The following documents provide details on the process, how to submit an appeal/protest and what types of information is needed.
The Federal Emergency Management Agency (FEMA) strongly encourages that appeals and protests be coordinated with the community officials. All appeals and protests must be forwarded to FEMA's Regional Office in Denton, Texas within the regulatory 90-day appeal period.
