Authorizes use of loan guarantees and direct loans for actions (such as new technologies) to protect and restore critical infrastructure, including private sector operations

New Requirement for a Consistent and Unified Federal System for Priorities and Allocations

DPA authorizes use of priority ratings in contracts and orders to ensure delivery of needed resources in emergencies and the domestic allocation of resources in short supply

Required to develop a “consistent and unified” Federal priorities and allocations system
-
Requires agencies with delegated DPA priorities and allocations authority to issue final rules governing use of this authority within 270 days (due by June 27, 2010)

FEMA is convening an interagency working group to coordinate this rule-making

New Requirement for a Defense Production Act Committee (DPAC)

DPAC members are heads of each Federal agency delegated DPA authority and the Chairperson of the Council of Economic Advisors (DHS Secretary a member of Committee)

President: (1) designates Cabinet level DPAC Chair; and (2) appoints DPAC Executive Director not subject to Senate approval (within Chair’s department)

DPA Committee prepares annual report to Congress (first report due by March 30, 2010)
