New DPA Support for Homeland Security Missions

• DPA Declaration of Policy now provides greater emphasis on use for homeland security, domestic disasters, critical infrastructure protection and restoration and terrorism
• DPA loan guarantee and loan authorities are now available for protection and restoration of private sector critical infrastructure operations
• DPA authorities explicitly support homeland security activities

New DPA Support for Strengthening U.S. Industry

• Authorizes use of loan guarantees and direct loans for actions (such as new technologies) to protect and restore critical infrastructure, including private sector operations
• Simplifies notification to Congress and enables quicker action to address industrial shortfalls

New Requirement for a Consistent and Unified Federal System for Priorities and Allocations

•  DPA authorizes use of priority ratings in contracts and orders to ensure delivery of needed resources in emergencies and the domestic allocation of resources in short supply
•  Required to develop a “consistent and unified” Federal priorities and allocations system
• Requires agencies with delegated DPA priorities and allocations authority to issue final rules governing use of this authority within 270 days (due by June 27, 2010)
• FEMA is convening an interagency working group to coordinate this rule-making

New Requirement for a Defense Production Act Committee (DPAC)

• DPAC members are heads of each Federal agency delegated DPA authority and the Chairperson of the Council of Economic Advisors (DHS Secretary a member of Committee)
• President: (1) designates Cabinet level DPAC Chair; and (2) appoints DPAC Executive Director not subject to Senate approval (within Chair’s department)
• DPA Committee prepares annual report to Congress (first report due by March 30, 2010)
  • Report recommends effective DPA use
